A guardianship is a legal proceeding in the circuit courts of Florida in which a guardian is appointed to exercise the legal rights of an in­capacitated person.  A guardian is an individual or institution such as a bank trust department appointed by the court to care for an incapacitated person.

Health Care Surrogate Designation
A health care power of attorney (also called an health care surrogate designation) allows you to appoint a trusted individual to make health care decisions on your behalf if you are unable to do so yourself. The document enables you to give instructions and express your wishes regarding your health care. For example, you can specify if you wish to receive life-sustaining procedures and give instructions concerning organ donation, disposition of remains, and your funeral. In the absence of such instructions, your family members are left with the burden of making such difficult decisions and may be forced to seek court intervention, with no guarantee that your wishes will be honored.

Powers of Attorney
Durable powers of attorney are created to protect you if you become incapacitated. It allows you to appoint someone you trust to manage your financial and personal affairs in the event that you become temporarily or permanently incapacitated. A durable power of attorney can include all real and personal property including stocks, bonds, mutual funds, bank accounts and other intangible personal property.

A durable power of attorney allows the person you designate to make financial decisions on your behalf. This financial power of attorney includes the authority to pay bills and manage all of your financial concerns.
